1. Our commitment
Equa Health is committed to handling personal information in accordance with the Privacy Act 1988 (Cth), the Australian Privacy Principles and applicable professional obligations. As a private health service provider holding health information, Equa Health is covered by the Privacy Act regardless of business size.
This policy explains how Equa Health WA PTY LTD, and relevant practitioners engaged by Equa Health, collect, use, hold and disclose personal information.
2. Information we collect
We may collect:
· identity and contact details, date of birth and emergency contact details;
· health history, symptoms, diagnoses reported to us, medicines, supplements, allergies, test results, family history and lifestyle information;
· appointment, consultation, correspondence and clinical records;
· billing, transaction and product-order information; and
· website and communications data, such as IP address, browser information and cookie or analytics data.
3. How and why we collect it
We usually collect information directly from you through bookings, forms, consultations, email, telephone, telehealth and product orders. With consent or where otherwise lawful, we may receive information from your representative, another health professional, a pathology provider or another relevant organisation.
We collect and use information to provide safe services, manage appointments and payments, maintain clinical and business records, communicate and coordinate care, arrange referrals and products, respond to complaints, improve our services, and meet legal, insurance and professional obligations. If necessary information is not provided, we may be unable to provide some services safely.
4. Sensitive information and consent
Health information is sensitive information. We collect it with your consent or where collection is otherwise permitted by law. We use it for the purpose for which it was collected, a directly related purpose you would reasonably expect, with further consent, or as otherwise permitted or required by law.
5. Disclosure and service providers
Where relevant, information may be disclosed to:
· practitioners engaged in your care and, with consent, your other health professionals;
· pathology, supplement, pharmacy, referral or product providers;
· booking, practice-management, telehealth, email, cloud-storage, payment, accounting, IT and security providers;
· professional advisers, insurers and regulators; and
· other recipients where authorised by you or permitted or required by law, including where necessary to respond to a serious threat to life, health or safety.
6. Overseas handling
Some technology providers may store or process information outside Australia. We take reasonable steps required by law when using overseas providers. Details may change as providers update their infrastructure; current information is available on request.
7. AI-assisted processing
Equa Health’s use of artificial intelligence involving client information is described in its separate AI Consent Form on booking. Optional AI use will not occur merely because you accepted this Privacy Policy. Where AI is used, Equa Health remains responsible for professional judgment, review and information handling.
8. Direct marketing
We do not use health information for direct marketing without specific consent. If you separately consent to receive marketing, you may opt out at any time using the unsubscribe facility or by contacting us. Administrative and clinical communications are not marketing.
9. Cookies and analytics
Our website may use necessary cookies and, if enabled, analytics or marketing technologies described in our cookie notice or consent tool. You can control optional cookies through that tool or your browser, although disabling necessary functions may affect the website.
10. Storage, security and retention
We use reasonable physical, technical and organisational safeguards, including access controls, password protection, secure systems, backups and staff confidentiality requirements. No system is completely secure. If an eligible data breach occurs, we will investigate and provide notifications required under the Privacy Act.
Records are retained for the periods required by applicable law, professional obligations and insurance requirements, then securely destroyed or de-identified when no longer required. Current clinical-record retention approach: ADULTS minimum 7 years; AND CHILDREN at minimum until age 18.
11. Access, correction and anonymity
You may request access to or correction of your information by contacting the Privacy Contact below. We will respond within a reasonable period and explain any lawful refusal. Identification may be required. We will not charge for making a request, although a reasonable access cost may apply where permitted and advised in advance.
You may deal with us anonymously or using a pseudonym where lawful and practicable. Identification will generally be necessary for personalised clinical care, billing and safe recordkeeping.
12. Privacy complaints

13. Changes and contact
We may update this policy prospectively. The current version and effective date will be published on our website. If a change requires fresh consent, we will seek it rather than relying solely on continued website use.
